TERMS OF USE

Before becoming a registered user of Aniday and using the services provided by Aniday, please read the “Aniday User Agreement” (hereinafter referred to as the “Agreement” or “Contract”) carefully so that you fully understand the services we provide as well as the rights and obligations that you enjoy and are responsible for. The moment you start using Aniday’s services, it means you have acknowledged and accepted all the terms in this Agreement.

This Agreement is concluded between you (hereinafter referred to as “User” or “You”) and Aniday Company Limited (hereinafter referred to as “Aniday” or “We”) regarding the rights and obligations you have when using the Aniday platform (hereinafter referred to as the “Platform” or “Aniday”). Aniday is a platform that supports transparent and serious recruitment activities. Prior to registration and usage, please read the terms below carefully.

Note: To ensure that your legitimate rights are not infringed, the Platform advises that before trusting any information on Aniday, you research thoroughly, self-verify information, and be vigilant against fraudulent forms of recruitment.

I. ACCEPTANCE OF TERMS UPON REGISTRATION

Based on the Cybersecurity Law and the “Regulations on the Management of Internet User Accounts” as well as other relevant laws of the State, once you complete verification via Email or SMS or click on a notation equivalent to agreeing to the “Aniday User Agreement” and other related agreements on the Aniday registration page, it means you have read, agreed, and entered into this Agreement with Aniday, becoming a user of Aniday. At the same time, you accept all terms of registration in this Agreement, as well as the Policies and other published agreements/rules on the Platform, including but not limited to the “Code of Conduct” and the “Service Agreement,” which contain dispute resolution provisions (see details in Article XV of this Agreement).

II. REGISTRATION AND USER ACCOUNT VERIFICATION

  1. Conditions for Account Registration
  2. When submitting information to register for an Aniday account, the User must simultaneously meet all the following conditions:
    • On the date of registration and throughout the service usage on Aniday, it must serve the purpose of recruitment and/or job seeking.
    • On the date of registration, the User must be at least 16 years old.
  3. Completeness and Accuracy of User Information
  4. To enjoy the maximum services of the Aniday Platform, the User must follow the Aniday registration process, providing honest, accurate, up-to-date, and complete personal information. Users registering and verifying as “Employers” (including business units or HR service companies) must promptly update relevant documents and information, such as the company name, HR service permit (if any) or labor introduction permit, job title or position, corporate email, recruitment authorization letter, letter of commitment, etc., ensuring the authenticity of the aforementioned information/documents. The User must ensure that all recruitment activities (including but not limited to posting vacancies, communicating with candidates, receiving/using/forwarding candidate resumes, etc.) remain valid and effective throughout the usage period. Once verified as an employer, the User must maintain a unique employer account corresponding to the authorized agency or unit.
  5. Consequences of Providing False Information
  6. Pursuant to relevant State laws, if the documents or registration details are inaccurate, untruthful, noncompliant, or if there is reason to believe that the supporting documents are forged or obtained illegally, Aniday has the right to refuse to provide the related functions. In such cases, you may not be able to use the Aniday Platform and related services, or certain features may be restricted.
  7. Serious Violation for Misuse
  8. If a User provides false personal or company information for registration, posts false job vacancies, or is unauthorized but autonomously obtains candidate resumes for non-recruitment purposes, it is deemed a serious violation of this Agreement. Aniday may suspend or terminate the violating User’s account and halt the provision of services. If such false postings cause economic or reputational damage to Aniday, Aniday reserves the right to pursue legal liability against the User.

III. ACCOUNT AND SECURITY

  1. User Responsibility
  2. The User is solely responsible for all activities carried out through their account, including any content, data, materials, text, software, music, sound, images, graphics, video, information, or other materials uploaded, posted, emailed, or otherwise transmitted through Aniday, whether public or private. The individual providing such content bears responsibility for it.
  3. Security Incidents
  4. If an unauthorized usage of the account or any security breaches are discovered, the User must immediately inform Aniday. If the account is compromised due to the User’s own error or for reasons unrelated to Aniday, causing data leakage, the User bears all adverse consequences.
  5. Account Ownership
  6. Ownership of Aniday accounts belongs to Aniday. Upon the User’s completion of the registration procedure, they obtain the right to use the Aniday account, which is held solely by the initial registrant. Furthermore, the User shall not gift, lend, rent, transfer, or sell the Aniday account to others, nor allow others to use the account in any form. No individual may acquire the account through gifting, inheritance, rental, transfer, or any other means. If we discover or have grounds to believe that the individual using the account is not the initial registrant, to protect account security, we may immediately suspend or terminate that account’s service usage, and we have the right to ban said account permanently.
  7. Prohibition on Third-Party Use
  8. The User must not independently provide the account (account details) to a third party or allow a third party to use the account (e.g., by hiring another person to purchase Aniday services on their behalf). Should this lead to disclosure of personal information of other users or economic loss to the Platform, the User shall be held fully responsible.
  9. Account Cancellation or Other Requests
  10. If you intend to discontinue use or cancel the phone number/email currently linked to the account, or if you have other inquiries or requests, please contact: hello@aniday.com

IV. EXPLANATION OF SERVICES

  1. Service Provision
  2. Aniday provides online services to Users via the internet, encompassing tasks related to both online and offline activities. To use these services, the User is responsible for equipping themselves with the necessary devices and internet connection (computer, modem, or equivalent) and covering any related internet access costs.
  3. Paid Services
  4. In delivering services online, Aniday may charge fees for certain services and will distinctly display a notice on the relevant page. If you refuse to pay, you will not be able to use the respective service. Concerning paid services, and pursuant to this Agreement, we will separately outline “Service Terms” to govern the content of paid services and each party’s rights and obligations. Please read them carefully; if you proceed to purchase paid services and related taxes, this implies acceptance of the stated terms.
  5. Service Validity
  6. Whether paid or free, all Aniday services have a specified validity period. Once that period expires, the service is automatically terminated. Absent other provisions, due to the digital nature of paid services, no returns (even within seven days without cause) are supported after purchase.
  7. Document Requests
  8. Out of risk management or recruitment safety considerations, Aniday may request that certain Users submit additional documents (including but not limited to legal entity certificates, letters of commitment, business contracts, etc.). We will specify the request on the relevant page or via email. Should a User refuse to provide these, Aniday may suspend or terminate part or all of the services, depending on the circumstances.
  9. Periodic Verification
  10. To satisfy local legal requirements and periodically verify and update information, Aniday may check the authenticity of company addresses, recruitment authorization, etc., for certain Users. During verification, Users must cooperate with Aniday staff by providing supplemental documents, such as the Business Registration Certificate, relevant qualifications/business agreements, Authorization Letter, the authorized representative’s ID, office lease contract/utility bills, etc., and allow the staff to inspect and photograph the company’s logo and office environment for documentation (specific instructions will be mentioned on the website). If a User refuses, Aniday may, depending on the situation, suspend or terminate part or all services.
  11. Actions Against Illegitimate Use
  12. If a User exploits the Aniday Platform for illegal activities or exhibits speech/behavior (whether online or offline) contrary to Aniday’s goal of serious recruitment, Aniday may, depending on the case, suspend or terminate some or all services. If such misconduct harms Aniday, we reserve the right to pursue legal liability.
  13. Promotional and Service-Related Messages
  14. Aniday may send notices, advertisements, promotions, etc., regarding Aniday’s services to Users by application, phone, SMS, or email, as well as invite feedback, surveys, and testing to improve quality and user experience.
  15. Sharing Job Postings
  16. In order to enhance Employers’ recruitment results, job vacancy information posted by Users on Aniday may be shared on our partner platforms and linked channels.
  17. Sharing Job-Seeking Information
  18. To improve your job search results, upon obtaining your permission, Aniday may share the job-seeking information you have provided on Aniday with our partner platforms.
  19. Virtual Goods (Credits, Points, etc.)
  20. Value-added services in the form of virtual items (e.g., “credit,” “points,” etc.) are issued or transferred directly by Aniday. Users must not purchase said virtual items or Aniday services through any other channels or platforms. Aniday is not liable for any losses resulting from using virtual goods or services not officially provided or sold by Aniday. If unauthorized top-ups through other platforms or third parties cause losses to Aniday, the User shall indemnify Aniday accordingly.
  21. Prohibition on Using Third-Party Tools
  22. Users may only use related services through this Platform and must not, without permission, use any third-party tools or platforms to access information/services on Aniday. This includes but is not limited to logging in, posting jobs, viewing job posts, or sending/receiving resumes. If using a third-party platform or process leads to data leaks, Aniday cannot be held responsible, and the User shall indemnify Aniday for any resultant damages (if any).
  23. Exporting Candidate Files
  24. If an Employer exports any candidate files from the Platform externally, they must comply with the Personal Data Protection Law and other relevant State regulations. All necessary measures to ensure the legality of the export of personal data must be taken.
  25. Third-Party Services and Disclaimers
  26. When a User employs services or platforms integrated by third parties within Aniday, aside from complying with the Agreement, they may need to consent to the terms of those third parties. Any dispute, loss, or damage arising between the User and the third party is the sole responsibility of the involved parties. When using a third-party payment service within Aniday, Users should carefully review and accept any applicable terms.

V. DISCLAIMER

  1. Disclaimer of Guarantee
  2. Although Aniday strives to provide safe, timely, accurate, high-quality services, we cannot guarantee that usage outcomes will match Users’ expectations or that services will not be interrupted, nor can we ensure timeliness, safety, or accuracy. Unless otherwise stated, Aniday is not liable if the User cannot use Aniday’s services or if the outcome does not meet personal expectations.
  3. Content Liability
  4. Regarding content transmitted by Users via Aniday’s services, we conduct reasonable reviews in line with the law but lack full control over all transmitted content. Aniday does not accept liability for verifying accuracy, completeness, or quality of this content. While using Aniday, you may encounter information that is offensive, improper, or objectionable. Any content uploaded or transmitted by a User (via email or otherwise) is the full responsibility of that User. However, Aniday is entitled to block the transmission of prohibited content according to law and implement suitable measures, including but not limited to suspending certain or all account privileges, preserving pertinent records, and reporting to the competent authorities when necessary.
  5. Third-Party Ads
  6. Aniday does not warrant the accuracy, legality, or reliability of any third-party information, links, or ads (if provided) on the Platform; such responsibility belongs to the advertiser. Any business interaction or transaction that a User conducts with an advertiser through Aniday is solely between the User and the advertiser, having no relation to Aniday. Consequently, Aniday disclaims liability for any losses or damages stemming from said transactions.
  7. User-Uploaded Materials
  8. As for images, documents, certificates, videos, content, or pictures that Users upload, despite our suitable review process, the accuracy, legality, or reliability of these items cannot be fully guaranteed. The User who uploads the material is solely accountable.
  9. User Self-Assessment
  10. Users must self-evaluate content posted by other Users on Aniday and assume any risks that arise from relying on such content, including but not limited to losses arising from trusting that content’s accuracy, completeness, or usefulness. Aniday disclaims any liability for losses or damages resulting from said risks.
  11. Downloaded Data Risk
  12. Users downloading or otherwise obtaining data from Aniday do so at their own risk; should these downloads damage computing systems or cause data loss, Aniday bears no liability.
  13. Recruitment Events
  14. For any recruitment or co-recruitment event hosted by Aniday, whether free or paid, Aniday does not guarantee the recruitment outcome or assure the legality or appropriateness of participant actions. Any physical, reputational, or other harm arising from participant behavior is the responsibility of the person engaged in that behavior.
  15. Complaint Handling
  16. If a User submits a complaint, Aniday will reasonably investigate and handle it to fulfill our Platform management obligations. Under legal provisions, Aniday may post complaint-related information or share it with the accused party.

VI. RIGHTS REGARDING USERS’ PERSONAL INFORMATION

  1. Personal Information Protection
  2. Aniday endeavors to safeguard Users’ personal information and privacy pursuant to relevant State legal provisions.

VII. USER OBLIGATIONS WHEN USING THE PLATFORM

  1. Scope of “Using the Platform”
  2. “Using the Platform” in this Agreement covers all User activities when utilizing Platform services (including but not limited to registration, login, verification, viewing posts, initiating chats, managing accounts, posting job openings, inviting interviews, commenting, etc.) and any action associated with an Aniday account.
  3. Compliance with Laws
  4. When using Aniday’s services, Users must comply with all applicable State laws and specialized legal provisions (e.g., the Civil Code, Cybersecurity Law, Data Security Law, Personal Data Protection Law, Employment Service Law, Labor Law, Copyright Law, relevant decisions or regulations of State agencies pertaining to cybersecurity, etc.).
  5. Prohibited Content
  6. It is forbidden for Users on Aniday to create, send, copy, publish, or disseminate content that violates the law, including but not limited to:
    • Acts against the fundamental principles determined by the Constitution.
    • Endangering national security, overthrowing the government, sabotaging national unity.
    • Impairing national honor and interests.
    • Inciting ethnic hatred or discrimination, threatening national unity.
    • Undermining religious policy, propagating cults, or superstition.
    • Spreading rumors, disturbing social order, or affecting stability.
    • Spreading pornography, violence, gambling, prostitution, terrorism, or inciting crimes.
    • Insulting or libeling others, infringing on others’ legitimate interests.
    • Containing false, harmful, offensive, provocative, obscene, or unethical content.
    • Including any content prohibited or restricted by State law.
  7. Prohibited Information
  8. It is prohibited for Users to create, post, or disseminate the following via Aniday:
    • Recruitment of underage workers.
    • Multi-level marketing, direct marketing, or advertising information.
    • Pornographic, vulgar, or lewd material.
    • Unlawful or politically sensitive content.
    • False information (e.g., inaccurate business data, wages, resumes, job openings...).
    • Posting fake job vacancies that do not match actual recruitment needs.
    • Any content violating Aniday’s “Code of Conduct.”
  9. Prohibited Acts to Infringe Rights
  10. Users are forbidden from exploiting Aniday to infringe on others’ or Aniday’s rights, including but not limited to:
    • Impersonating or misrepresenting affiliation with any individual or organization, including Aniday employees, or providing false statements regarding identity or affiliation.
    • Stalking or harassing other Users.
    • Illicitly collecting, altering, storing, or deleting others’ data/emails, or exploiting those data for illegal purposes.
    • Interfering or attempting to interfere with the Platform’s operations; creating or distributing tools to facilitate such interference.
    • Violating rules, regulations, restrictions, or policies of the Platform, or circumventing them.
    • Using any “plugin,” “external app,” or any third-party tool to access Aniday or extract its data/systems without permission.
  11. Prohibited Acts That Harm the Platform
  12. Users must not perform actions that damage the Aniday ecosystem, such as:
    • Recruiting others for unlawful work.
    • Abusing equipment fees (e.g., training, uniforms) to defraud and seize an applicant’s assets.
    • Maliciously harassing other Users.
    • Exploiting any vulnerabilities to load/withdraw points or use the service illegally.
    • Buying/selling points (credits) or Aniday services on external platforms.
    • Registering or verifying with fake information; posting spam jobs or content related to multi-level marketing, pornography, or subversion; disclosing interview chat logs; failing to pay wages to multiple employees, etc., are considered severe violations of this Agreement.
    • Other acts violating the “Code of Conduct.”
  13. Other Illegal Acts
  14. Users must not use the Aniday Platform for other illegal activities, such as:
    • Leveraging the chat feature for fraud, multi-level marketing, boosting visits/ratings, advertising contraband, etc.
    • Forging or causing confusion with account names, profile pictures, or company introductions to post jobs, or impersonating another person’s name to recruit.
    • Delaying or failing to pay wages or costs to employees, infringing on employees’ lawful rights.
    • Independently or by authorizing/helping third parties to gather data from the Platform illegally (spiders, bots, etc.).
    • Providing automatic login services or manufacturing/falsifying documents to bypass identity verification.
    • Any other action violating the “Aniday Recruitment Behavior Management Rules.”

If the User breaches any of these, it constitutes a violation of this Agreement. Aniday reserves the right to take enforcement measures in accordance with Article VIII and seek liability where necessary.

VIII. LIABILITY FOR VIOLATIONS

  1. Remedial Measures
  2. If Aniday verifies or reasonably suspects that a User has violated Article VII, Aniday may delete, hide, or block the content and restrict some or all relevant features. To prevent further damage, Aniday may, depending on severity, suspend or completely terminate services to the User without prior notice. If the violation causes damages to Aniday, we reserve the right to claim full compensation from the User.
  3. Indemnity for Third-Party Claims
  4. If a violation leads to damages or causes a third party to file a complaint or lawsuit against Aniday, the User is responsible for compensating Aniday or our partners, including but not limited to settlement fees, legal fees, investigative expenses, etc.
  5. False or Malicious Complaints
  6. If a User complains about another User’s violation but that complaint proves false or malicious, the complainant shall bear responsibility. If it impairs the legitimate rights or interests of others or affects Aniday’s reputation, the complainant must also provide recompense.

IX. USER CONTENT UPLOADED OR POSTED ON ANIDAY

  1. License to Aniday
  2. For any content (including but not limited to images, text, interview experiences, comments, etc.) that the User uploads or posts on Aniday, the User grants Aniday and its affiliates a free, non-exclusive right to use such content. Aniday is authorized to copy, edit, and publish the content for display, promotion, or dissemination. This usage right remains valid until the User submits a written request for cessation of usage, starting from the date Aniday receives the request.
  3. Infringement of Third-Party Rights
  4. If the uploaded or posted content violates another party’s rights or interests, resulting in a third-party complaint against Aniday, the responsible User bears full liability.
  5. Third-Party Copying
  6. Any copying, altering, or redistribution of content that a User posts in public areas on Aniday by a third party is conducted by that third party independently, and they assume any resultant legal liability. Aniday is not involved.

X. DIRECT CHAT, INTERVIEW

  1. Data Retention
  2. According to State Law, Aniday may temporarily store conversations between Users (via text, video, etc.) for the sake of providing search functionality, handling complaints, and ensuring security and risk management strategies.
  3. Prohibition on Disclosure
  4. To protect privacy, you must not arbitrarily download, disseminate, or publicly disclose other Users’ chat content (e.g., interview transcripts). If this causes damage to Aniday or infringes on other Users’ rights, you shall be liable for compensation or for the violation.

XI. ACCOUNT DELETION SERVICE

The User has the right to request deletion of their Aniday account at any time, subject to the relevant rules and procedures for account cancellation. After successful deletion, Aniday will delete or anonymize your personal data in accordance with State law.

XII. MODIFICATIONS AND CHANGES TO AGREEMENT TERMS

Aniday is entitled to amend any terms of this Agreement in accordance with State regulations. When changes occur, we will update and announce them on the Aniday Platform or send the latest version to the User via system messages, pop-up notices, or email.

If the User disagrees with such modifications, please cease using Aniday or request account deletion; unused paid benefits will be forfeited. Continued use of the account signifies acceptance of the revised terms.

XIII. FORCE MAJEURE

  1. Definition of Force Majeure
  2. “Force Majeure” is an event beyond Aniday’s reasonable control, or not preventable even if foreseeable, making it impossible for Aniday to fulfill all or part of its obligations under the Agreement. Events like government policy, natural disasters, war, hacking, computer viruses, network incidents, etc., can disrupt or delay access to Aniday, result in data losses or leaks of personal information.
  3. Suspension of Obligations
  4. Upon any Force Majeure event, Aniday may suspend executing its obligations until the event ceases, without being held liable for breach. Aniday shall endeavor to minimize negative impacts during this period.

XIV. NOTIFICATIONS

Aniday may send notifications to Users via system messages, pop-up windows, email, or public announcements on the Platform. When changes to the User Agreement or other content occur, we may inform you through such channels.

XV. GOVERNING LAW AND JURISDICTION

The validity, performance, interpretation, and dispute resolution arising from this Agreement are governed by the current laws of the State where Aniday is registered as a legal entity. In case of disagreements, both parties shall endeavor to negotiate; failing that, you agree to submit the dispute to the court at the place of Agreement conclusion. If any provision of this Agreement becomes invalid due to conflict with State law, it shall not affect the validity of the remaining provisions.
